If a copyright holder exceeds his legal rights by sharing the content, this important right may be infringed. In the event of a DMCA take down notification, the alleged infringer may file a counter-complaint with the service provider in response to the DMCA notice.
While DMCA takedown service providers may remove infringing content upon receipt of a notification, it may be worthwhile for copyright holders to submit a DMCA notice to a service provider, even if the provider has not appointed a proxy.
Many service providers do not participate in the DMCA system and content may not be removed until the service provider has removed the infringing content in response to the DMCA notification.
